Terms of Service

1. Acceptance and Eligibility

These Terms of Service ("Terms") govern your use of the Dwaar AI website, the Basera resident app, the Nazar guard app, the RWA admin portal, and the FASTag, ANPR and facial recognition hardware installed at your community's gate (together, the "Services"), operated by Entriva Technologies Pvt. Ltd. ("Dwaar AI", "we", "us", "our").

By registering for or using the Services, whether as a resident, visitor, guard, staff member or community administrator, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.

You must be at least 18 years old to create an account. A parent, guardian or the community administrator may register and manage access on behalf of a minor resident, such as a child living in the community.

2. Your Account

When you or your community administrator creates an account, you agree to provide accurate, current and complete information, including your name, phone number, unit details and vehicle information where applicable. You are responsible for keeping your login credentials confidential and for all activity that happens under your account.

Community administrator accounts, used by RWA committees and management staff to configure gates, residents, staff and guards, may be subject to additional verification before activation. We may suspend or request correction of any account that contains information we reasonably believe to be false, outdated or incomplete.

3. Description of Services

Dwaar AI is a technology platform. We provide the software and hardware that verify vehicles and people at your community's gate, log entries and exits, and support resident, guard and administrator workflows. We are not a security agency, and we do not employ, supervise, hire or fire the guards deployed at your community; that responsibility rests with your community or its chosen security vendor.

The Services are provided on an "as is" and "as available" basis. While we work to keep the platform reliable, we do not guarantee that the Services will be uninterrupted, error free, or available at all times, particularly during network outages, power failures or hardware maintenance at your gate.

Final entry and exit decisions at your community's gate remain in the control of your community's guards and administrators. Dwaar AI provides verification signals through FASTag, ANPR and facial recognition to support that decision, and a guard can always override the system manually.

4. Your Community's Responsibilities

If you are a management committee, RWA or administrator using Dwaar AI on behalf of a community, you agree to:

• Provide accurate resident, vehicle, staff and guard records, and keep them updated as people move in, move out, or change vehicles
• Obtain any consent required under applicable law before enrolling residents, staff or guards for facial recognition, particularly where staff attendance is being tracked
• Ensure guards and staff are trained to use the Nazar app and to manually verify entry when the system flags an exception
• Configure retention settings for visitor logs and camera footage in line with your community's own policies and applicable law

Dwaar AI is not responsible for decisions your community makes about who is authorised to enter, how long access records are retained beyond our platform defaults, or disputes between residents, guards and visitors that arise independently of a platform malfunction.

5. Gate Hardware and Security Components

The FASTag reader, ANPR camera and facial recognition camera installed at your gate are part of the Services and remain, unless otherwise agreed in a separate signed order, the property of Dwaar AI or its hardware partners. You agree not to override, disable, tamper with, reverse engineer or otherwise interfere with this hardware or the software that operates it.

If gate hardware is damaged, removed or interfered with, verification may fall back to manual guard checks until the issue is resolved. Report any hardware fault to our support team promptly using the contact details in Section 16.

6. Acceptable Use

When using the Services, you agree not to:

• Upload, submit or register information that is false, misleading, or that impersonates another person or vehicle
• Use the Services to harass, defame, threaten or unlawfully discriminate against a resident, guard, staff member or visitor
• Attempt to gain unauthorised access to another user's account, another community's data, or any part of the Services not intended for you
• Use the Services in a way that violates any applicable law, including laws relating to data protection, surveillance or workplace consent

We may investigate suspected violations and take appropriate action, including removing content, suspending accounts or reporting unlawful activity to the relevant authorities.

7. Fees and Payment

Pricing and payment terms for Dwaar AI's platform and hardware are set out separately in the order form or agreement signed between Entriva Technologies Pvt. Ltd. and your community, and are not published on this website. Where fees apply, your community's administrator is responsible for ensuring timely payment to keep the Services active; residents typically do not pay Dwaar AI directly for gate access.

8. Intellectual Property

The Dwaar AI name, the Basera and Nazar app names, our logos, software, hardware designs and website content are the property of Entriva Technologies Pvt. Ltd. and are protected by applicable intellectual property law. You may not copy, modify, distribute or create derivative works from any part of the Services without our prior written permission.

If you believe content on our platform infringes your intellectual property rights, contact us using the details in Section 16.

9. Third Party Links and Services

Our website and apps may link to third party websites or services, such as payment processors or mapping tools. We do not control and are not responsible for the content, accuracy or practices of any third party site. Visiting a linked site is at your own risk and subject to that site's own terms.

10. Termination and Suspension

We may suspend or terminate access to the Services, with or without notice, if we reasonably believe an account has been compromised, used fraudulently, or used in violation of these Terms. Where the platform relationship is with a community rather than an individual resident, termination of the community's agreement with Dwaar AI ends access for that community's residents, staff and guards, and any locally cached verification data is deactivated accordingly.

You or your community may stop using the Services at any time by notifying us, subject to any separate notice period in your community's signed agreement.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non infringement. We do not warrant that FASTag, ANPR or facial recognition verification will be error free or will detect every unauthorised entry attempt; these are verification aids, and human oversight by your community's guards remains part of the system.

12. Limitation of Liability

To the maximum extent permitted by law, Entriva Technologies Pvt. Ltd. will not be liable for indirect, incidental, special or consequential damages arising from your use of the Services, including losses related to theft, security incidents, or unauthorised entry that occurs despite the Services operating as intended. Where liability cannot be excluded, our aggregate liability for any claim relating to the Services is limited to the fees actually paid to us by your community for the Services in the twelve months preceding the claim.

13. Indemnity

You agree to indemnify and hold Entriva Technologies Pvt. Ltd. harmless from claims, damages or expenses arising from your misuse of the Services, your violation of these Terms, or your violation of any third party's rights, except where the claim arises from our own fraud, misrepresentation or negligence.

14. Governing Law and Disputes

These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of the Services will be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services or applicable law. We will update the "Last updated" date at the top of this page when we make a material change, and where required, we will notify your community's administrator directly. Continued use of the Services after an update means you accept the revised Terms.
